Republic Day greetings - let us resolve to protect the Basic Structure of our Constitution.

BSNLEU conveys it’s best wishes and warm greetings on the occasion of the Republic Day of India. It was on 26th January, 1950, that India became a Republic. It was on this day the Constitution of India came into effect. Fundamental Rights, Federalism, Secularism, Free and fair elections, Checks and balances among the organs of the State, are some of the elements of the Basic Structure of the Constitution. This Basic Structure of the Constitution came under attack during the authoritarian Indira Gandhi regime. It was argued that the Parliament can change the Constitution in whichever way it wanted. But, in the landmark Kesavananda Bharati case judgement, delivered in 1973, the Supreme Court has concretely stated that, the Basic Structure of the Parliament cannot be changed by the Parliament. This is called the Basic Structure Doctrine. However, recently, the Vice President, Shri Jagdeep Dhankhar has questioned the Kesavananda Bharati judgement. He has stated that, the Parliament is supreme. This argument is being repeated by the Law Minister, Kiren Rijiju. This is nothing but attack on the Basic Structure of the Constitution. Thus, once again the Constitution has come under attack. While celebrating the Republic Day, let us resolve to protect the Basic Structure of our Constitution.
