Lunch hour demonstration is being organised throughout the country today, as per the call of the AUAB.

The AUAB has called on the employees to organise country wide lunch hour demonstrations today the 04.12.2019, demanding immediate payment of the salary for the months of October & November, 2019. As per reports being received by the CHQ, these demonstrations have been organised effectively throughout the country. BSNLEU congratulates the AUAB and all it’s constituents for this successful programme.

VRS window closed – 78,569 employees opted for VRS.

As per the VRS scheme implemented by the Management, the window for giving option was opened on 04.11.2019. The window was closed yesterday the 03.12.2019. It is learnt that, totally 78,569 employees have opted for VRS. As per the VRS-2019, the total number of employees eligible for going on VRS is 1,04,471. Thus, 75.2% of the employees who are eligible to go on VRS, have opted for it. It is also learnt that 5,237 employees, after submitting their option for VRS, have withdrawn the same.

Organise powerful lunch hour demonstrations tomorrow..

The AUAB has already called on the Executives and Non-Executives of BSNL to organise lunch hour demonstrations tomorrow the 04.12.2019, demanding immediate payment of salaries for the month of October & November, 2019. The CHQ of BSNLEU calls upon the circle and district secretaries to organise the lunch hour demonstration powerfully, by coordinating with the other constituents of the AUAB.

Management seeks deployment of 200 more ITS officers in BSNL– sees growing tendency of indiscipline among deployed (ITS) officers.

The ET Telecom, in it’s edition today, has reported that Shri Arvind Vadnerkar, Director (HR), has written to the DoT, demanding for the deployment of 200 additional ITS officers in BSNL, in addition to the existing 550 ITS officers, already working in the Company, to man important senior managerial posts. It is also reported that the Director (HR) has informed the DoT that, there is a growing tendency of indiscipline among the deployed (read ITS) officers. It must be noted that the ITS Association had questioned the wisdom of the BSNL Management, which has offered VRS to the Group A officers who are already working in BSNL and simultaneously demanding the DoT to send more ITS officers to BSNL.  The ITSA has also sought repatriation back to the DoT, of all the ITS officers working in BSNL, which will help the Company to save money.

Jio, Airtel, Vodafone Idea announce huge increase in their tariffs – BSNL should also increase it’s tariff to come out of the financial crisis.

Airtel and Vodafone Idea have increased their call charge and data charge upto 45%. Similarly, Jio has announced increase in it’s tariffs by 40%. The increase in tariffs announced by all the three private operators is certainly a huge one. Now, BSNL should also increase it’s tariffs to match with the private operators tariffs. This will help BSNL to come out of the crisis. It may be recollected that on many occasions in the past, BSNLEU has forecasted that tariffs will increase in the near future and thereby BSNL’s financial condition will also greatly improve.

 

At this juncture, BSNLEU wishes to inform all that, with the allotment of 4G spectrum and drastic increase in call and data charges, BSNL is likely to come out of it’s financial crisis soon. Hence, those employees who have opted for VRS, fearing about the future financial condition of BSNL, can very well withdraw their VRS options.

एयरटेल और वोडाफोन आईडिया ने उनके कॉल चार्ज और डेटा चार्ज  में 45% तक वृद्धि की है। इसी प्रकार जिओ ने अपने टैरिफ में 40% तक वृद्धि घोषित की है। निःसंदेह, तीनों ही निजी ऑपरेटर्स द्वारा टैरिफ में घोषित की गई वृद्धि बेहद अधिक है। BSNL को भी निजी ऑपरेटर्स के समान अपने टैरिफ में भी वृद्धि करनी चाहिए। इससे BSNL को मौजूदा संकट से उबरने में मदद होगी। ज्ञातव्य है कि पूर्व में कई अवसरों पर BSNLEU ने यह भविष्यवाणी की थी कि निकट भविष्य में टैरिफ में वृद्धि होगी और तदनुसार BSNL की वित्तीय स्थिति में भी व्यापक सुधार होगा।

AUAB ने अक्टूबर और नवंबर 2019 के त्वरित वेतन भुगतान की मांग को ले कर, सभी एग्जीक्यूटिव्ज और नॉन एग्जीक्यूटिव्ज से 04.12.2019 को भोजन अवकाश में प्रदर्शन आयोजित करने का आव्हान किया है। इस हेतु AUAB द्वारा सेक्रेटरी,  टेलीकॉम और CMD BSNL को आज आवश्यक नोटिफिकेशन जारी कर दिया गया है। AUAB ने यह भी मांग की है कि BSNL कर्मियों और डेप्यूटेशन पर कार्यरत ITS ऑफिसर्स को वेतन वितरण में किसी प्रकार का पक्षपात नही होना चाहिए। साथ ही, AUAB ने BSNL मैनेजमेंट और DoT को चेतावनी दी है कि अक्टूबर और नवंबर 2019 के त्वरित वेतन भुगतान न होने की स्थिति में उग्र आंदोलन शुरू किया जाएगा।

BSNLEU files complaint with the Cyber Crime Cell, against obnoxious WhatsApp messages, vilifying the image of trade unions..

Certain miscreants in BSNL are continuously spreading obnoxious WhatsApp messages, to damage the image of BSNLEU and it’s leaders in particular and that of other unions and associations in general. BSNLEU and the AUAB are continuously fighting to protect the interests of BSNL employees and the Company. Inspite of this, certain mischievous elements continue to spread WhatsApp messages, abusing the trade unions and it’s leaders. The whole intention of spreading such messages is to weaken the trade unions and to create an anarchic situation in BSNL. Yesterday, a WhatsApp message has been sent, abusing unions and associations in an intemperate language and telling the leaders to commit suicide, by jumping into the Yamuna River in Delhi. There is a limit to tolerate such nonsense. Hence, BSNLEU has decided to take action against this obnoxious WhatsApp messages. Accordingly, Com.P.Abhimanyu, General Secretary has lodged a complaint today, to the Deputy Commissioner of Police, Cyber Crimes Cell of the Delhi Police. Similarly, Com.J.Sampath Rao, AGS, has lodged a complaint in the Cyber Crimes Cell of Hyderabad Police. In addition to this, Com.S. Chellappa, AGS, has lodged a complaint in the Cyber Crimes Cell of Chennai Police. Hereafter, BSNLEU will teach a proper lesson to each and every miscreant who abuse BSNLEU and it’s leaders, through the social media platforms.

Neither the BSNL Management nor the DoT are willing to provide safety to the VRS optees on Pension Commutation and 3rd PRC - VRS optees are requested to think twice and to take the wise decision.

The VRS window closes on 03.12.2019. There are only a few more days for it. The BSNL Management and the DoT have not come forward to clear some crucial uncertainties connected with the VRS-2019.  Hence, it has become clear that neither the BSNL Management, nor the DoT, are going to ensure the following safeguards, being demanded by the unions and associations.
 

(1)    Commutation of Pension.

Amendment to the Pension Commutation Rule 1981 to ensure safety measures to the employee who go on VRS. This is demanded because, according to the Commutation of Pension Rule 1981, an employee has to apply for pension commutation within one year of his retirement. Whereas, according to the VRS-2019, Pension Commutation will be given to the VRS optees only when they complete the age of 60 years.

 

According to the present rules, all those who apply for their Pension Commutation after one year of their going on VRS, will have to undergo a medical examination, which will create unnecessary complications and problems to a large section of the employees.

 

Further if any of the VRS optee expires before attaining the age of 60, his family will not get the benefit of pension commutation, which will be a huge loss to that family. This is a provision contained in the present rule. The unions and associations have demanded that, relaxation should be given to the VRS optees as a special case, from the above clause.

 

Both the above relaxations can be given only by amending the Commutation of Pension Rules 1981, by the Department of Pension and Pensioners Welfare. Any oral or written assurance given by the DoT or BSNL Management will not serve the purpose. However, it is unfortunate that neither the BSNL Management nor the DoT has taken any step to ensure necessary safety to the VRS optees.

 

(2)     Eligibility for 3rd PRC.

The Supreme Court judgement says that an employee who goes on VRS is not entitled for Wage Revision, implemented subsequently and retrospectively. As per the provision of the VRS-2019 also, employees who go on VRS are not entitled for 3rd Pay Revision. Para 8 (viii) of VRS 2019 Rule reads as follows:-

 

“The benefits payable under this scheme shall be in full and final settlement of all claims of whatsoever nature, whether arising under the scheme or otherwise.”

 

This means, the exgratia being paid to the VRS optees is the full and final settlement and thereafter, they are not entitled for the 3rd PRC, when implemented later on and retrospectively.

 

The unions and associations demand that the BSNL Management should give an assurance that, the VRS optees would be made eligible for the 3rd PRC. However, the BSNL Management has not taken any action to give this assurance. This clearly shows that the VRS optees are not going to get the benefit of 3rd PRC.


Under the above mentioned circumstances, those employees who have already given option for VRS, are requested to think twice and take a wise decision before the VRS window closes on 03.12.2019.

VRS ऑप्टीज के लिए पेंशन कम्युटेशन और 3rd PRC के मुद्दे पर सुरक्षा मुहैया करवाने हेतु न तो BSNL मैनेजमेंट और न ही DoT इच्छुक है- VRS ऑप्टीज से अनुरोध हैं कि वें पुनर्विचार करें और उचित निर्णय लेवें...

VRS विण्डोज 03.12.2019 को बंद होने जा रही है। इसमें कुछ ही दिन शेष हैं। VRS-2019 से जुड़ी कुछ महत्वपूर्ण अनिश्चितताओं को  BSNL मैनेजमेंट और DoT अभी तक स्पष्ट नही कर पाए हैं। इससे यह स्पष्ट प्रतीत हो रहा है कि यूनियन्स और एसोसिएशन्स की मांग अनुसार निम्न सुरक्षोपाय (safeguards) सुनिश्चित करने हेतु न तो BSNL मैनेजमेंट और न ही DoT तैयार है।


(1) पेंशन कम्युटेशन

VRS पर जा रहे कर्मचारियों के लिए सुरक्षा उपायों की सुनिश्चितता हेतु पेंशन कम्युटेशन नियम 1981 में संशोधन हो। यह मांग इसलिए की जा रही है कि, पेंशन कम्युटेशन नियम 1981 के अनुसार कर्मचारी को पेंशन कम्युटेशन हेतु अपने रिटायरमेंट के एक वर्ष के भीतर आवेदन देना होता है। जबकि VRS-2019 के अनुसार VRS ऑप्टीज को पेंशन कम्युटेशन उनकी आयु 60 वर्ष पूर्ण होने पर ही दिया जाएगा।

किन्तु, अभी विद्यमान नियमों के अनुसार  VRS पर जाने वाले उन सभी कर्मचारियों को, जो  1 वर्ष की समयावधि पश्चात पेंशन कम्युटेशन हेतु आवेदन देंगे,  मेडिकल जांच करवाना होगी, जिससे कर्मचारियों के एक बड़े वर्ग के लिए अनावश्यक पेचीदगियां और समस्याएं निर्मित होगी।

इसके अलावा, VRS ऑप्टी की VRS पर जाने की दिनांक से 60 वर्ष की आयु पूर्ण होने के मध्य यदि मृत्यु हो जाती है तो VRS ऑप्टी के परिवार को पेंशन कम्युटेशन का लाभ नही मिलेगा। फलस्वरूप, VRS ऑप्टी के परिवार को भारी नुकसान होगा। वर्तमान नियमों में इस प्रावधान का समावेश है। अतः, यूनियन्स व एसोसिएशन्स ने मांग की है कि, VRS ऑप्टीज को, उक्त क्लॉज़ से,  विशेष प्रकरण मान कर,


छूट दी जाए। उपर्युक्त दोनों ही छूट (relaxations) डिपार्टमेंट ऑफ पेंशन एंड पेंशनर्स वेलफेयर द्वारा पेंशन कम्युटेशन नियम 1981में संशोधन करने पर ही दी जा सकती है। इस संबंध में BSNL मैनेजमेंट या DoT द्वारा किसी भी प्रकार के मौखिक या लिखित आश्वासन देने से उद्देश्य पूर्ति नही होगी। लेकिन यह दुर्भाग्यपूर्ण है कि VRS ऑप्टीज के लिए इन मुद्दों पर आवश्यक सुरक्षा सुनिश्चित करने हेतु न तो BSNL मैनेजमेंट और न ही DoT ने कोई कदम उठाए हैं।

(2) 3rd PRC की पात्रता
माननीय सर्वोच्च न्यायालय का निर्णय (judgement) कहता है कि, जो कर्मचारी VRS पर जाता है, उसे कुछ समय पश्चात और पूर्व दिनांक से हुए पे रिवीजन की पात्रता नही होगी। VRS 2019 के प्रावधान अनुसार भी जो कर्मचारी VRS पर जाएंगे उन्हें 3rd PRC की पात्रता नही होगी। VRS 2019 के Para 8 (viii) में भी यह स्पष्ट रूप से कहा गया है कि

" इस योजना के अंतर्गत देय लाभ के रूप में ही, इस योजना में समाहित या अन्य, सभी प्रकार के क्लेम्स का पूर्ण रूप से अंतिम निपटान (full & final settlement) माना जाएगा।"

इसका मतलब यह है कि VRS ऑप्टीज को दिया जा रहा एक्सग्रेशिया फुल और फाइनल सेटलमेंट है और इसके पश्चात उन्हें कुछ समय बाद पूर्व दिनांक से लागू होने पर 3rd PRC की पात्रता नही होगी।

यूनियन्स और एसोसिएशन्स ने मांग की है कि BSNL मैनेजमेंट यह आश्वासित करे कि VRS ऑप्टीज को 3rd PRC की पात्रता होगी। किन्तु, इस तरह का आश्वासन देने हेतु BSNL मैनेजमेंट ने कोई पहल नही की है। इससे यह स्पष्ट हो जाता है कि VRS ऑप्टीज को 3rd PRC का लाभ नही मिलेगा।


ऊपर उल्लेखित परिप्रेक्ष्य में, जिन कर्मचारियों ने VRS का ऑप्शन दे दिया है, उनसे अनुरोध है कि वें पुनर्विचार करें और 03-12-2019 को VRS विंडो बंद होने के पूर्व उचित निर्णय लें।

BSNLEU strongly condemns the BSNL Management for the non-payment of salary.

Salary for the month of October 2019 was not paid. Today is 30th November and the salary for the month of November, 2019 is also not paid. In the talks held with the AUAB on 18.11.2019, The Director (HR) assured that the October salary would be paid on 28.11.2019. However the Management has not honoured this assurance. It is not known when these two months' salary would be paid. What has been happening in the MTNL has started happening in BSNL also, especially after the new CMD has taken over the charge. The salary is not being paid, only to create a scare and to compel more employees to go on VRS. BSNLEU strongly condemns this attitude of the BSNL Management. BSNLEU will take recourse to suitable action, in consultation with other Unions and associations.

Privatisation of the BPCL should be an eye opener to BSNL employees.

The Narendra Modi government has already taken decision to privatise the Bharat Petroleum Corporation Ltd. (BPCL), which is a huge profit earning PSU. Absolutely there is no need or justification to privatise it. Prior to 1971, BPCL was a multinational oil company. After the 1971 Indo- Pakistan war, this company was nationalised by the then Prime Minister, Smt. Indira Gandhi, because the Company refused to fuel Indian Air force's fighter jets, during India's war with Pakistan. It is unfortunate that the Modi government is reversing the history today and wants to hand over this Public Sector oil behemoth to some Indian or multinational corporates. This act of the government to privatise BPCL is nothing but anti- national. Those who preach about "Nationalism" from roof tops should make a self introspection and think how India's "national interests" are being compromised by the Narendra Modi government. The Central Trade Unions have called for a one day General Strike on 8th January, 2020, against the privatisation of the Public Sector by the Modi government. BSNLEU has also decided to join this General Strike. We call upon the BSNL employees to join this General Strike enmasse. If we remain as silent spectators any more, days will not be far away, when BSNL will also be handed over to Ambani or Adani.

नरेंद्र मोदी सरकार ने भारत पेट्रोलियम कारपोरेशन लिमिटेड (BPCL), जो कि एक बेहद मुनाफे वाला PSU है, के निजीकरण का निर्णय ले लिया है। जाहिर है, उसके निजीकरण की जरूरत नही है और उसके निजीकरण का कोई आधार भी (justification) नही है। 1971 के पूर्व  BPCL एक बहुराष्ट्रीय तेल कंपनी थी। 1971 के भारत पाकिस्तान युद्ध के बाद तत्कालीन प्रधानमंत्री श्रीमती इंदिरा गांधी द्वारा इस कंपनी का राष्ट्रीयकरण कर दिया गया था, क्योंकि भारत के पाकिस्तान के साथ युद्ध के दौरान इस कंपनी ने भारतीय एयरफोर्स के लड़ाकू जेट्स को ईंधन आपूर्ति से इंकार कर दिया था। यह दुर्भाग्यपूर्ण है कि मोदी सरकार इतिहास को पलट रही है और एक विशालकाय पब्लिक सेक्टर तेल कंपनी को किसी भारतीय या बहुराष्ट्रीय कॉर्पोरेट को सौंपना चाहती है। भारत सरकार का BPCL के निजीकरण का कृत्य राष्ट्र विरोधी होने के अलावा और कुछ नही है। जो सतही तौर पर "राष्ट्रवाद" की बाते करते हैं, उन्हें आत्मावलोकन करना चाहिए और सोचना चाहिए कि किस तरह मोदी सरकार "राष्ट्रीय हितों"  के साथ समझौता कर रही है। मोदी सरकार की पब्लिक सेक्टर की निजीकरण की नीतियों के विरोध में केंद्रीय श्रम संगठन ने 8 जनवरी, 2020 को आम हड़ताल का आव्हान किया है। इस आम हड़ताल में BSNLEU ने भी शामिल होने का निर्णय लिया है। हम सभी BSNL कर्मियों से अनुरोध करते हैं कि वें समग्र रूप से इस हड़ताल में शामिल हों। यदि हम अभी भी एक मूक दर्शक बने रहेंगे तो वह दिन दूर नही जब BSNL भी अम्बानी या अडानी को सौंप दिया जाएगा।

The GDP growth of India tumbles further - at 4.5%, it is the lowest in the 6 ½ years.

As India is gripped in an economic crisis, it’s GDP continues to tumble. In the July-September quarter, the GDP growth has fallen to 4.5%. This is the lowest GDP growth since March, 2013, i.e., during the past 6 ½ years. It may be noted that the GDP growth during the previous quarter, i.e., during April to June 2019, remained at 5%. It is for sure that the GDP growth may plunge to 4% in the next quarter. It is a matter of serious concern that India, which was the fastest growing economy a few years ago, is in shatters now. Rightly, it is being said by some political critics that, India’s economy is in an ICU today.

Shri K.K. Ragesh, CPIM, MP, raises the issue of non-payment of wages to contract workers.

Shri K.K. Ragesh, the CPI(M)  MP from Kerala, raised the issue of the contract workers in the Rajya Sabha yesterday, during the zero hour. He pointed out that the contract workers were not paid wages for the past many months, as a result of which many contract workers had already committed suicide. He also pointed out that the contract workers who had worked in BSNL for the past many years are being retrenched. He demanded that the contract workers should be paid wages immediately. It is notable to mention that Com.K.K. Raghesh is the President of the BSNL CCWF, Kerala circle.

श्री के के रागेश, केरल से CPIM सांसद ने कल राज्यसभा में शून्यकाल के दौरान कॉन्ट्रैक्ट वर्कर्स को वेजेस का भुगतान नही किए जाने का मुद्दा उठाया। उन्होंने यह संज्ञान में लाया कि विगत कई महीनों से कॉन्ट्रैक्ट वर्कर्स को वेजेस का भुगतान नही हुआ है, फलस्वरूप कई कॉन्ट्रैक्ट वर्कर्स आत्महत्या कर चुके हैं। उन्होंने यह भी ध्यान में लाया कि कई कॉन्ट्रैक्ट वर्कर्स जो BSNL में विगत कई वर्षों से कार्य कर रहे हैं, उनकी छंटनी की जा रही है। उन्होंने मांग की कि कॉन्ट्रैक्ट वर्कर्स को वेजेस का भुगतान त्वरित किया जाए। ज्ञातव्य है कि कॉम के के रागेश BSNL CCWF, केरल सर्किल के अध्यक्ष हैं।

A special meeting of BSNL employees, held at Meerut on 29.11.2019 on VRS issue.

BSNL Employees Union, Meerut district conducted a special mass meeting of BSNL employees at Meerut on 29.11.2019 on the VRS issue. The meeting was presided over by Com.Ramswarup, District President. Com.Naresh Pal, Organising Secretary (CHQ) and District Secretary, Meerut, welcomed all. Com.Swapan Chakraborty, Dy.GS, explained at length on shortcomings of VRS and expressed that VRS is not at all beneficiary for the lower level employees, VIZ., TT, ATT, etc. The higher level Management in BSNL is hoodwinking the lower level employees, by giving threatening and false statements on VRS. Employees in the lower level have to see what they are getting in VRS and what they are loosing, he said. The meeting was also addressed by Com.Upender Singh Teotia, CS, UP(West) and the vote of thanks was given by Com.Ansar Ali, Circle President. A large number of employees irrespective of union affiliation attended the meeting.

Extended CEC meeting of BSNLEU Odisha Circle.

The Extended Circle Executive Committee meeting of BSNLEU was held at Bhubaneswar on 29.11.2019. Com.S.Bhattacherjee, CP, presided over the meeting. Com. Saroj Ranjan Das, CS, initiated the proceedings. Com. A Dhupal and Com.P.R.Das, veteran leaders were present in the meeting. Com. Sisir Kumar Roy, Org. Secretary(CHQ) addressed the meeting and explained about the present anti-PSU policies of the Modi Government, BSNL's  revival package, the post VRS-2019 scenario, and the General Strike on 8th January, 2020, were explained in detail. He called on the Executive Committee members to organise the General Strike effectively. Various queries raised by the members were also clarified.

Uttarakhand Circle Executive Committee decided to participate in the 08th January, General Strike.

The Circle Executive Committee meeting of BSNLEU, Uttarakhand circle, was held at Dehradun on 28.11.2019. The meeting was presided over by Com.G.P. Kala, Circle President. Com.K.S. Soun, Circle Secretary, submitted the brief report on activities and initiated the discussions. All the District Secretaries and Circle Office Bearers participated in the discussions and raised queries on VRS and Revival Package declared by the government. Com.Swapan Chakraborty, Dy.GS, in his address reported in detail on Central Trade Unions' decision to organise the General Strike on 08th January, 2020 and on the decision of the CEC meeting to massively participate in the General Strike. He also dealt with the issues of VRS, BSNL's Revival Package and replied to the queries related to VRS. The Circle Executive Committee decided to make the General Strike successful in Uttarakhand circle.
