The gratuity money of an employee can be withheld and forfeited for recovery of dues such as overstaying in official accommodation, the Supreme Court has ruled. A bench headed by justice Sanjay K Kaul held that, there is no prohibition against recovering dues including penal rent -- the rent with penalty for overstaying in official accommodation -- from an employee’s gratuity.

Five Non-Executives were high handedly transferred from Nagaon SSA to Tezpur SSA in Assam circle. One of the transferees is Com.Debasis Majumdar, District Secretary, BSNLEU, Nagaon, who is enjoying immunity from transfers, as per Corporate Office orders. BSNLEU objected to these transfers and wrote to the Director (HR), BSNL. Consequently, the transfers are kept under abeyance. However, BSNLEU has written to the Director (HR) today, demanding total cancellation of the transfer orders, since the transfers have been issued in total violation of Corporate Office orders on the subject.
BSNLEU has given call for organising placard showing campaign today throughout the country, in support of the farmers’ agitation. Accordingly, comrades organised this campaign by showing placards carrying slogans in support of the farmers’ agitation. The slogans included “withdraw the pro-corporate Farm Acts”, “withdraw the Electricity Amendment Bill (2020)”, “ensure statutory Minimum Support Price”, etc. CHQ heartily congratulates all the circle and district unions which have successfully organised the programme.
Serious violations of the facility of immunity from transfers, are being reported from some circles. CHQ is promptly taking up those issues with the Corporate Office. For example, the District Secretary of BSNLEU, Vadodara, was recently transferred out of the district. The transfer has since been settled, at the intervention of the Corporate Office, based on the complaint from the CHQ of BSNLEU. These mischieves are being done by some circle administrations, utilising a particular provision of the Corporate Office order, which states, “immunity from transfer is subject to administrative convenience”. Hence, the Corporate Office has issued an instruction to all the CGMs, giving suitable instruction.
In total violation of all the existing rules, five Non-Executives were transferred out of their districts, in Assam circle, in the name of Consolidation of Business Area. These comrades are transferred from Nagaon SSA to Tezpur SSA. The list of comrades transferred includes Com.Majumdar, District Secretary, BSNLEU, Nagaon. CHQ immediately intervened in this matter. Letter was written. Com.P.Abhimanyu, General Secretary, discussed the matter with the Director (HR) and the GM(Restructuring). Consequent to this, the CGM, Assam, has issued letter and has kept all the transfers under abeyance. BSNLEU will not allow Non-Executives being transferred out of the SSA in the name Consolidation of Business Areas.
The Kerala circle union of BSNLEU has donated Rs.60,000/- to the farmers’ agitation. This is a very positive initiative by our Kerala circle union, which highlights their class consciousness. CHQ heartily congratulates the Kerala circle union.
Com.Swapan Chakraborty, Dy.GS, retired from service on supernation on 30.04.2020 in the midst of the total lock-down. Now, that the restrictions have been removed, a function is organised at Agartala on 22.12.2020, to felicitate Com.Swapan Chakraborty, Dy.GS. The function was presided over by Com.Debojit Majumder, President, Tripura district and Com.Mintu Ch. Bhowmik, President, BSNLCCWU. Com.Babul Das, DS, BSNLEU, Com.Purnendu Das, SNEA, Shri Bikash Sarkar, DGM, BSNL and many others addressed and praised the services of Com.Swapan Chakraborty, Dy.GS.

01.10.2020, 01.01.2021 और 01.04.2021 को देय तीन IDA फ्रीजिंग के संबंध में DPE ने स्पष्ट रूप से कहा है कि IDA फ्रीज करने का निर्णय केवल सेंट्रल पब्लिक सेक्टर एंटरप्राइजेज के एग्जीक्यूटिव्ज और नॉन यूनियनाइज्ड सुपरवाइजर्स पर ही लागू होगा। यह सेंट्रल पब्लिक सेक्टर एंटरप्राइजेज के नॉन एग्जीक्यूटिव्ज पर लागू नहीं होगा। माननीय केरल उच्च न्यायालय और साथ ही माननीय कर्नाटक उच्च न्यायालय ने आदेश पारित किए हैं, जिसमें स्पष्ट किया गया है कि IDA फ्रीज करने का निर्णय केवल सेंट्रल पब्लिक सेक्टर एंटरप्राइजेज के एग्जीक्यूटिव्ज और नॉन यूनियनाइज्ड सुपरवाइजर्स पर ही लागू होगा। इस परिप्रेक्ष्य में, BSNLEU द्वारा 01.10.2020 से देय IDA की किश्त के तत्काल भुगतान की मांग करते हुए पहले ही CMD BSNL को पत्र लिखा जा चुका है। इसके अलावा, BSNLEU, कानूनी निदान की संभावनाएं भी तलाश रही है। इस संबंध में CHQ द्वारा कॉम संतोष कुमार, सर्किल सेक्रेटरी, BSNLEU, केरल को आवश्यक पहल करने हेतु निर्देशित भी किया जा चुका है। यह उस तथ्य के परिप्रेक्ष्य में है कि नॉन एग्जीक्यूटिव्ज का IDA फ्रीज करने के विरोध में प्रथम आदेश माननीय केरल उच्च न्यायालय द्वारा पारित किया गया है।
As regards, the freezing of three IDAs, falling due on 01.10.2020, 01.01.2021 and 01.04.2021, the DPE has categorically mentioned that the freezing of IDA is applicable only to the Executives and to the Non-Unionised Supervisors of the CPSEs. The Hon’ble Kerala High Court, as well as the Hon’ble High Court of Karnataka have passed orders stating that, the IDA freezing is only applicable to the Executives and Non-Unionised Supervisors. In view of this, BSNLEU has already written to the CMD BSNL, demanding that, the IDA instalment which has become due from 01.10.2020, should be paid immediately. Further, BSNLEU is also exploring the option of seeking legal remedy. The CHQ has already directed Com.Santhosh Kumar, Circle Secretary, BSNLEU, Kerala, for taking the necessary initiative. This is in view of the fact that, the first order, against IDA freezing for the Non-Executives, is passed by the Hon’ble Kerala High Court.

BSNLEU के ऑल इंडिया सेन्टर की कल 22.12.2020 को मीटिंग हुई, जिसमें वर्तमान में जारी किसान आंदोलन, जो कि आज 28वें दिन में प्रवेश कर चुका है और जिसमें 33 से अधिक किसान अपनी जान गंवा चुके हैं, के समर्थन में एकता प्रदर्शित करने के लिए कार्यक्रम आयोजित करने पर चर्चा हुई। इस तथ्य को ध्यान में रखते हुए कि BSNLEU द्वारा किसान आंदोलन के समर्थन में 2 राष्ट्रव्यापी प्रदर्शन पूर्व में आयोजित किए जा चुके हैं, निम्न निर्णय लिए गए।
(1) किसानों की मांगों के लिए जन समर्थन हासिल करने के लिए 26.12.2020 को "तख्ती प्रदर्शन कार्यक्रम" (placard showing programme) आयोजित किया जाए। यह कार्यक्रम कम से कम आधे घंटे के लिए सार्वजनिक स्थानों, जैसे बाजार स्थल, बस स्टैंड आदि के समीप, आयोजित किया जा सकता है। हमारे साथी, किसानों की मांगों के समर्थन में लिखी तख्तियां प्रदर्शित करते हुए कम से कम 30 मिनट के लिए कतारबद्ध हो कर खड़े रहें।
(2) हमारे साथीगण, आंदोलन के दौरान दिवंगत हुए 33 किसानों के प्रति अपनी संवेदना प्रकट करने के लिए 26.12.2020 को काली पट्टी लगाएं।

भारत सरकार के असिस्टेंट सॉलिसिटर जनरल ने माननीय उच्च न्यायालय, केरल को सूचित किया है कि 01.10.2020, 01.01.2021 और 01.04.2021को देय IDA फ्रीज करने का भारत सरकार का निर्णय केवल एग्जीक्यूटिव्ज और नॉन यूनियनाइज्ड सुपरवाइजर्स पर ही लागू होगा। यह सेंट्रल पब्लिक सेक्टर एंटरप्राइजेज के नॉन एग्जीक्यूटिव्ज पर लागू नहीं होगा। इस आधार पर, माननीय उच्च न्यायालय, केरल ने FACT में कार्यरत नॉन एग्जीक्यूटिव्ज का IDA फ्रीज करने का आदेश खारिज कर दिया है। अतः, BSNLEU ने 01.10.2020 से देय IDA के तत्काल भुगतान की मांग करते हुए CMD BSNL को पत्र लिखा है।
The All India Centre of BSNLEU has decided to donate Rs.One lakh to the farmers’ agitation. Representatives of BSNLEU will hand over the cheque for Rs.One lakh, to the All India Kisan Sabha at the Singhu Border, which is the main venue of the agitation, on 26.12.2020.
The All India Centre meeting held yesterday the 22.12.2020, discussed about further solidarity programme, in support of the ongoing farmers’ agitation, which has entered the 28th day today, in which 33 kisans have already lost their lives. Considering the fact that BSNLEU has already organised two country wide demonstrations in support of the farmers’ agitation, the following decisions are taken:-
(1) On 26.12.2020 a placard showing programme is to be organised, to mobilise public opinion in support of the demands of the farmers. This programme can be organised at least for half an hour in public places like near shopping areas, near the bus stand, etc. Our comrades should stand in a line at least for 30 minutes, showing placards, with slogans supporting the demands of the farmers.
(2) Our comrades should also wear black-badges on 26.12.2020, to express our grief over the death of 33 farmers, while participating in the agitation.
Circle and district secretaries are requested to take urgent steps to make the programme successful. Report and photos of the programme may be sent to the CHQ.
The Circle Executive Committee meeting of BSNLEU, Kerala circle, held online on 19.12.2020, has decided to organise agitational programmes against the indiscriminate outsourcing, directing the Group ‘C’ employees to perform Group ‘D’ duties in the name of e-filing, non-payment of wages to contract workers and other issues. The meeting has decided to observe Call Attention Day on 30.12.2020, demonstrations on 07.01.2021 and mass dharna on 20.01.2021. The meeting has also decided to intensify the agitation if issues are not settled.
Tamil Nadu circle union of BSNLEU and TNTCWU are continuously organising agitational programmes against the severe deterioration of services in the circle, which has arisen due to the mindless retrenchment of the contract workers and the indiscriminate outsourcing of works. The CGM, Tamil Nadu circle has thrown to the winds, the assurances that he had given to the union on 05th November, 2020. Hence, demanding immediate action to improve the services, as well as to implement the assurances given by the CGM, Tamil Nadu circle, BSNLEU and TNTCWU are conducting continuous agitational programmes. In this connection, a massive dharna is organised today at the CGM Office, Tamil Nadu circle. 700 regular employees, contract workers and pensioners have participated in this programme. Leaders of SNEA, AIBSNLEA, NFTE and AIBDPA, greeted the comrades and expressed their solidarity with the agitation.
The Corporate Office has allotted funds to the circles today, for payment of salary for the month of November, 2020. Consequent this, the November salary will be disbursed today or tomorrow.

BSNLEU is extremely saddened to hear that Com.Raghunath Singh, the National Vice President of CITU, as well as General Secretary of CITU, Punjab, has passed away. He was readmitted in hospital for post COVID-19 complications. Com. Raghunath Singh was a militant and hardworking comrade and had been a great friend of BSNLEU. His death is a very big loss to the working class movement. BSNLEU pays it’s respectful homage to Com.Raghunath Singh and conveys it’s heartfelt condolences to the family members of the departed leader.
The farmers’ agitation has entered the 25th day, demanding withdrawal of the 3 Anti-Farmers' Acts, as well as the Electricity Bill-2020. It is important to note that, the Samyukta Kisan Morcha, which is spearheading the Farmers' struggle has already given a call to boycott the products of Ambani and Adani, including the Jio mobile, Reliance petrol and Adani food products.
Under these circumstances, the Samyukta Kisan Morcha is planning to give call for an Anti-corporates Day, for which an online consultation meeting is being organised at 06:00 pm today. It is a matter of privilege for us that, BSNLEU is invited to attend this online meeting. Accordingly, Com.P.Abhimanyu, General Secretary, will be participating in this online meeting.
India has got the dubious distinction of being the second most affected country by COVID-19, only next to the United States. Despite the tall claims made by the Modi government, it is a fact that the handling of the pandemic by the government is inept. When the pandemic was fast gripping the entire world, the Modi government mobilised lakhs of people at Ahmedabad on 24th February, 2020, in honour of Donald Trump. Similarly, the unprecedented lock-down was imposed in the whole country by the Modi government, by giving only a 3 hour notice. This brought untold miseries to the 12 crore migrant workers in the country. On the top of everything, even this pandemic was used by the RSS parivar to spread communal hearted. They unleashed a venomous propaganda that the people belonging to a particular religion is responsible for the spread of COVID-19. However, it gives relief that the situation is improving in most parts of the country. At this movement, BSNLEU salutes the doctors, nurses, health workers and all the frontline workers, who have immensely contributed in safeguarding mankind from this unprecedented human disaster. BSNLEU also salutes and pays it’s respectful homage to all those frontline workers who have laid down their lives in this battle.
