आज AUAB द्वारा 3 दिवसीय हड़ताल का नोटिस दिया गया। हड़ताल का नोटिस जारी करने का निर्णय आज AUAB की मीटिंग में लिया गया। मीटिंग में गहन चिंता के साथ यह महसूस किया गया कि AUAB द्वारा मुद्दों के निराकरण हेतु किए गए प्रयासों, विशेष रूप से 3rd पे रिवीजन के मुद्दे पर, कोई खास प्रगति नही हुई है। साथ ही, आज सम्पन्न AUAB की मीटिंग में बीएसएनएल के रिवाइवल से जुड़े कुछ और मुद्दे शामिल करने का निर्णय भी लिया गया। सभी सर्किल और डिस्ट्रिक्ट सेक्रेटरीज से अनुरोध है कि वें AUAB के अन्य घटकों के सहयोग से प्रभावी रूप से हड़ताल करें। हमारे पास उपलब्ध  समय बेहद कम है, अतः सर्किल और डिस्ट्रिक्ट सेक्रेटरीज हड़ताल आयोजित करने के लिए युद्ध स्तर पर प्रयास करें।

The Unions and Associations of BSNL are demanding the government to approve BSNL’s Land Management Policy, since the revenue generated through the monetisation of BSNL’s vacant lands can be funded for the development and revival of the Company. But, now, the government has decided to ringfence the proceedings from the monetisation of BSNL’s vacant lands, for funding the VRS. This is a well thought of plan, to deprive BSNL of the funds needed for it’s development and financial revival.

BSNLEU की विस्तारित सीईसी मीटिंग, पुणे में दिनांक 29 से 31 जुलाई 2019 तक होने जा रही है। यूनियन संविधान के प्रावधान अनुसार विस्तारित सीईसी मीटिंग में केवल सर्किल सेक्रेटरीज, सीएचक्यू ऑफिस बेयरर्स और डिस्ट्रिक्ट सेक्रेटरीज को ही शामिल होने की पात्रता है। अन्य किसी को भी इस मीटिंग में शामिल होने की इजाज़त नही मिलेगी। अतः, सर्किल और डिस्ट्रिक्ट सेक्रेटरीज से अनुरोध है कि वें अपने साथ किसी अन्य साथी को विस्तारित सीईसी मीटिंग में लेकर न आवें। साथ ही, यदि विस्तारित सीईसी मीटिंग में डिस्ट्रिक्ट सेक्रेटरी का आना संभव न हो, तो डिस्ट्रिक्ट सेक्रेटरी के स्थान पर केवल असिस्टेंट डिस्ट्रिक्ट सेक्रेटरी को ही मीटिंग में शामिल होने के लिए अधिकृत किया जाए। सभी सर्किल और डिस्ट्रिक्ट सेक्रेटरीज से अनुरोध है कि वें इसका पालन करें और सीएचक्यू एवं स्वागत समिति को सहयोग करें।

Com.P.K. Jain, Organising Secretary (CHQ), has retired from service on superannuation, on 31^st August, 2019. Com.P.K. Jain, who is also the District Secretary of BSNLEU, Jaipur district, has immensely contributed for the growth and strengthening of BSNLEU in Rajasthan circle. CHQ heartily congratulates Com.P.K. Jain and wish him a long, healthy and peaceful retired life.

Some employees are raising the doubt, whether employees who go on VRS are entitled for Pay Revision. A judgement delivered by the Delhi High Court on 26^th February, 2017, in the Sanjay Behari vs. IFCI Ltd. case, has said that employees who go on VRS are not entitled for any Pay Revision given retrospectively, for the period when they were in service. The relevant portion of the judgements says as follows:-

It is (VRS) a package deal of give and take. That is why in business world it is known as "Golden Handshake". The main purpose of paying this amount is to bring about a complete cessation of the jural relationship between the employer and the employee. After the amount is paid and the employee ceases to be under the employment of the company or the undertaking, he leaves with all his rights and there is no question of his again agitating for any kind of his past rights, with his erstwhile employer including making any claim with regard to enhancement of pay scale for an earlier period.

26th January, 1950 is the day on which the Constitution of India is born and India became a Republic. The Constitution of India is based on Mahatma Gandhiji's thought that, India belongs to the people following all religions, viz., Hinduism, Islam, Christianity, Sikhism, Buddhism, etc. Thus, the Gandhian thought of secularism is the basis of our Constitution. However, today, the BJP government is taking all out efforts to change the secular character of the Indian Constitution. The CAA (Constitution Amendment Act) the NPR (National Population Registry) and the NRC (National Registry of Citizenship) being brought by the government, are nothing but to change the secular character of our Constitution. Prominent intellectuals of India and abroad have deplored the CAA, NPR and the NRC. Massive protests are taking place through the country against them. BSNLEU conveys it's warm greetings to all the comrades, as well as to all the people of our great nation, on this occasion of the Republic Day. BSNLEU also resolves to oppose the CAA, NPR and the NRC. Long live the great Republic of India. Long live the secular character of Indian Constitution.

26 जनवरी, 1950 वह दिन है जब भारत के संविधान का जन्म हुआ और भारत गणतंत्र बना। भारत का संविधान महात्मा गांधी के विचारों पर आधारित है जिसके अनुसार भारत सभी धर्मों का पालन करने वाले लोगों का देश है, जैसे  हिंदुत्व, इस्लाम, क्रिश्चन, सिख, बौद्ध आदि। इस तरह से गाँधीजी का धर्मनिरपेक्षता का विचार संविधान का आधार है। किन्तु, आज, BJP सरकार भारतीय संविधान के धर्मनिरपेक्ष ताने बाने को छिन्न भिन्न करने पर आमादा है। सरकार द्वारा लाए जा रहे CAA (संविधान संशोधन अधिनियम), NPR (राष्ट्रीय जनसंख्या रजिस्टर) और NRC (राष्ट्रीय नागरिक रजिस्टर) और कुछ नही, वरन हमारे संविधान के धर्मनिरपेक्ष स्वरूप को परिवर्तित करने का प्रयास है। भारत और विदेश के प्रतिष्ठित बुद्धिजीवियों ने   CAA, NPR और NRC की भर्त्सना की है। इनके खिलाफ देश भर में व्यापक आंदोलन हो रहे हैं।

10 Central Trade Unions have given call for nationwide protest action on 03^rd July, 2020, opposing the attacks on Labour Rights, privatisation of the Public Sector, etc. Utilising the restrictions imposed during this lock-down period, the Narendra Modi government is launching serious attacks on  Labour Rights. The working hours has been increased from 8 hours to 12 hours. All the Labour Laws are being changed in favour of the employers and the corporates. Quick steps are also being taken to privatise the  Public Sector Undertakings.  Against these, the Central Trade Unions have decided to launch serious struggles, to resist and to defy the anti-labour and pro-corporate steps being taken by the Modi government. As a prelude to those actions, the Central Trade Unions have given call for protest action on 03^rd July, 2020.

AUAB ने निर्णय लिया है कि श्री अनंतकुमार हेगड़े, MP द्वारा BSNL एम्प्लॉईज की छवि धूमिल करने वाले अपमानजनक बयान की भर्त्सना करने के लिए कल दिनांक 13-08-2020 को भोजन अवकाश में विरोध प्रदर्शन आयोजित किया जाए। साथ ही, इस मुद्दे को लेकर, AUAB ने कल   11:00 hrs से 13:00 hrs के बीच ट्विटर अभियान चलाने का भी सभी कर्मचारियों से आव्हान किया है। सभी सर्किल और डिस्ट्रिक्ट सेक्रेटरीज से अनुरोध है कि इस कार्यक्रम को सफलतापूर्वक आयोजित करें।

BSNLEU has already urged upon the BSNL Management to immediately form the Joint Committee for negotiating the wage revision. BSNLEU has also demanded that wage negotiation should start without further delay, in view of the fact that notification has already been issued by the DPE. Com. P. Abhimanyu, GS, com. Swapan Chakraborty, Dy.GS, com. Animesh Mitra, Vice President (CHQ) and com. M.K. Dave, AGS, met shri A.M. Gupta, GM(SR), and enquired about the status of this issue. The GM (SR) replied that the Corporate Office has already written to the DoT, seeking necessary permission for starting wage negotiation.

The Circle Executive Committee meeting of Chhattisgarh circle was held at Raipur on 28.04.2018. Com.S.H.Dani, Circle President, presided over the meeting. Com.R.S.Bhatt, Circle Secretary, welcomed everyone and placed the report on activities. Com.K.R.Yadav, Vice-President(CHQ), addressed the meeting and spoke on important current issues, such as wage revision, Subsidiary Tower Company, revival of BSNL, etc. He also explained in detail on the decisions of the Agartala CEC meeting. The house was also addressed by Com. R.P. Atmapoojya, Circle Secretary, AIBDPA. After detailed deliberations by the executive committee members, important decisions are taken to strengthen the Organisation, and also to effectively implement the calls of the AUAB and BSNLEU. 

An enthusiastic & very impressive convention of Madhya Pradesh BSNL Working Women was conducted by the circle union of BSNLEU at Indore on 26.06.2018. Com.B.S. Raghuwanshi, Circle President, presided over. Com.Prakash Sharma, Circle Secretary, presented the report elaborating on women's issues and active participation of Working Women in union activities in MP circle. Com. P. Indira,  Convenor,  AIC,  BSNL WWCC,  presented keynote address in the seminar on "Role of women power in strengthening BSNL". She also presented a note on working women activities and anti people, anti worker, anti-PSU policies in the post lunch session. Chief Guest of the seminar Dr.  Mahesh Shukla, CGMT, delivered special address. PGMs Indore Shri M.R. Rawat and Shri Suresh Babu Prajapati, AIC member Com. Meena Choradia, COS, Com. Chitra greeted the convention. Besides this Young lady JEs and other Comrades participated in deliberations. 11 member committee with 5 joint convenors and Com.Mamta Bhavsar as convenor elected as WWCC MP Circle. With this, MP Circle became the 5th circle to form WWCC. Despite incessant rain 180 women and 40 male Comrades enthusiastically participated.  Convention was a big success with very fine arrangements made by reception committee led by Com. Hemant Dube. CHQ heartily congratulates the MP circle union and the newly elected BSNL WWCC, MP circle.

Com. P. Abhimanyu, GS, Com. Swapan Chakraborty, Dy.GS and Com. Animesh Mitra, Vice President (CHQ), met Shri Saurabh Tyagi,Sr.GM(Estt.), yesterday and discussed the following issues.
 

1. Issuing notification for holding JTO LICE.

BSNLEU is insisting the Management, for the past several months, to hold the JTO LICE. A decision in this regard is yet to be taken by the Establishment Branch of the Corporate Office. In view of the impending implementation of the CPSU hierarchy, the Establishment Branch has sought some clarification from the Personnel Branch of the Corporate Office on the matter. However, it is understood that, no clarification has come from the Personnel Branch. The BSNLEU representatives who met the Sr.GM(Estt.) yesterday, expressed their serious concern on the inordinate delay in holding the JTO LICE, and insisted that the Establishment Branch should issue the necessary notification without further delay. The Sr.GM(Estt.) shared the concern of the representatives and assured that needful action would be taken immediately.

2. Settlement of the issue of downgradation of Sr.TOAs from 7100 pay scale to 6550 pay scale.

This issue was once again discussed yesterday by the representatives of BSNLEU. They pointed out that the settlement of this issue is getting delayed. The Sr.GM(Estt.) has replied that, certain clarifications issued by the Corporate Office  on this subject earlier, need to be scrutinised, before taking a final decision. He replied that the Establishment Brach is on the job and that necessary action would be taken expeditiously.

3. One time relaxation for appearing in the TT LIDCE.

BSNLEU is pressuring the Corporate Management for a very long time, to give one time relaxation to the non-10th standard  candidates for appearing in the Telecom Technician LDCE. The Corporate Office has called for certain inputs from the circle on the subject. It seems response has not come from any circles. Under this circumstance, the representatives of BSNLEU insisted upon the Sr.GM(Estt.) to send the proposal for the approval of the BSNL Board without further delay. The Sr.GM(Estt.) assured to do the needful.

01.12.2018 से नुक्कड़ सभाएं आयोजित कीजिए- अनिश्चितकालीन हड़ताल को आम नागरिकों से व्यापक सहयोग मिले, यह जरूरी है।

AUAB की 20.11.2018 को सम्पन्न मीटिंग ने सभी यूनियन्स व एसोसिएशन्स को हमारी डिमांड्स और अनिश्चितकालीन हड़ताल के समर्थन में आम नागरिकों से व्यापक सहयोग प्राप्त करने का आव्हान किया है। मीटिंग ने निर्णय लिया कि इस हेतु 01.12.2018 से हड़ताल खत्म होने तक लगातार नुक्कड़ सभाएं आयोजित की जाए। विशेष रूप से, मीटिंग में यह निर्णय लिया गया कि 03.12.2018 से नुक्कड़ सभाओं में सभी एग्जीक्यूटिव्ज व नॉन एग्जीक्यूटिव्ज बड़े पैमाने पर शामिल हों। आम नागरिकों के बीच हमें यह अभियान प्रभावी रूप से चलाना है कि बीएसएनएल का पब्लिक सेक्टर कंपनी के रूप में अस्तित्व इस देश के नागरिकों के लिए कितना जरूरी है। सरकार की बीएसएनएल विरोधी और निजी समर्थक नीतियां, विशेष रूप से रिलायंस जियो के समर्थन में सरकार का सहयोग, प्रभावशाली तरीके से आम जन के बीच रखना चाहिए। बीएसएनएल ईयू के सभी सर्किल और डिस्ट्रिक्ट सेक्रेटरीज से अनुरोध है कि वें AUAB के अन्य घटकों से सामंजस्य कर इस अभियान को जनता के बीच ले जाने की पहल करे।

VRS is not a panacea for the financial crisis of BSNL. VRS is already implemented twice in MTNL. Still, MTNL is neck-deep in crisis. Why VRS has not helped MTNL to come out of the crisis? Can the government give answer to this question? The whole idea of the government in implementing VRS in BSNL, is to cut down the size of the workforce, to make it attractive for future privatisation. Implementation of VRS is nothing but the road map for the privatisation of BSNL. Those young employees who think of supporting VRS should understand this.

It is known to everyone that the present corporate management is devoting more energy, money and time to crush the trade union rights in BSNL, rather than managing other affairs of the Company. Ever since, the unions and associations of BSNL started to collectively struggle for the settlement of 3rd Pay Revision, the BSNL Management started taking every step to crush the struggles. In pursuit of this design, the BSNL Management has now banned even demonstrations and dharnas. The AUAB, in it's countrywide demonstrations held on 07.08.2019, has raised it’s voice against the autocratic steps being taken by the BSNL Management to curb trade union rights in BSNL. Ultimately, when the BSNL Management directed the participating unions not to organise even demonstrations and dharnas, till the completion of the 8th Membership Verification, BSNLEU was compelled to seek legal remedy. Based on BSNLEU’s write petition, the Hon’ble Madras High Court has stayed the BSNL Corporate Office’s letter dated 02nd July, 2019, which has banned even demonstrations and dharnas in BSNL. VRS का मतलब नियोक्ता और कर्मचारी के बीच संबंधों की पूर्ण इतिश्री (समाप्ति) है....इस अनुसार, जो कर्मचारी VRS पर जाएंगे उन्हें पूर्व प्रभाव से देय पे रिवीजन की पात्रता नही होगी...

कुछ कर्मचारी आशंका व्यक्त कर रहें हैं कि जो कर्मचारी VRS पर जाएंगे, क्या उन्हें पे रिवीजन की पात्रता होगी। दिल्ली हाइकोर्ट द्वारा 26 फरवरी 2017 को संजय बिहारी विरुद्ध IFCI लिमिटेड के प्रकरण में दिए गए जजमेंट के अनुसार जो कर्मचारी VRS पर जाएंगे उन्हें उनके सेवाकाल की अवधि के लिए पूर्व प्रभाव से देय पे रिवीजन की पात्रता नही होगी। इससे संबंधित जजमेंट निम्नानुसार है:-

यह (VRS) आदान प्रदान हेतु एक पैकेज डील है। इसी लिए व्यावसायिक क्षेत्र (business world) में इसे "गोल्डन हैंडशेक" के नाम से जाना जाता है। इस राशि के भुगतान का आशय ही नियोक्ता और कर्मचारी के बीच विधिक संबंधों की पूर्ण समाप्ति है। एक बार भुगतान हो जाने पर एवं कर्मचारी के कंपनी या उपक्रम के अधीन कार्यरत न रहने पर , वह अपने पूर्व नियोक्ता से अपने सभी अधिकारों का परित्याग कर देता है, और उसके पूर्व के अधिकारों की प्राप्ति हेतु उसे किसी भी प्रकार से उद्वेलित (agitating) होने का प्रश्न ही नही है, जिसमें पूर्व समयावधि के पे स्केल में वृद्धि की मांग करना भी शामिल है।
